The Delhi High Court on Thursday, January 21, refused to stay the release of the movie The White Tiger on digital streaming platform Netflix on grounds of a petition by US producer John Hart Jr, expressing copyright infringement, PTI reported.

In a last-minute hearing, Judge C Hari Shankar, hearing the case, dismissed the stay petition, stating that not a single valid reason had been shown for approaching the court less than 24 hours before the film's release. The court, however, proceeded with a summons to Netflix and the film's producer, Mukul Deora. The court cited the matter for completion of pleadings before the joint registrar on March 22.

The White Tiger story is based on a book of the same name, written by Aravind Adiga, and was scheduled for release on Netflix on Thursday night. The book was released in March 2008 and Adiga won the Man Booker Prize for the story.

Attorney Kapil Sankhla, who represents Hart Jr, said a literary auction agreement was reached between him and Adiga in March 2009, under which the producer was to make an "Oscar-worthy movie" based on the book, to be released in Hollywood. However, in October 2019, he learned that Netflix was in the process of making and releasing the film, following which he sent a legal notice to Deora and Netflix to seize and desist from any such act, PTI reported.

Sankhla also represented Sonia Mudbhatkal, who runs a US-based production company. The lawyer expressed that his clients were never given the impression that film shooting was taking place in 2020, as all such activities were suspended overseas due to the covid-19 pandemic.
